Rueckzahlungsklausel für Aus- und Fortbildung

  • Klassische BAG-Linie: nur wirksam, wenn:
  • der Mitarbeiter einen geldwerten Vorteil aus der Fortbildung zieht,
  • die Bindungsdauer in einem angemessenen Verhältnis zur Fortbildung steht (Faustregel: bis 1 Monat — kein Bindung, 1-2 Monate — bis 6 Monate, 2-4 Monate — bis 1 Jahr, 6-12 Monate — bis 3 Jahre, > 24 Monate — bis 5 Jahre).
  • Klausel muss differenzieren nach Kuendigungsgrund (Eigenkuendigung des Arbeitnehmers schadet, betriebsbedingte Kuendigung des Arbeitgebers nicht).

Vertragsstrafe im Arbeitsvertrag

  • Die Paragrafen 307 bis 309 BGB gelten grundsätzlich auch für Formulararbeitsverträge; arbeitsrechtliche Besonderheiten sind nach Paragraf 310 Absatz 4 Satz 2 BGB zu berücksichtigen.
